NairobiDeals is an online marketplace operated by GACUURIA THOONJO MARKETPLACE, trading as NairobiDeals Hadada. The platform enables buyers and independent vendors to list, discover, market, and purchase products online.

NairobiDeals offers a digital marketplace environment but, unless expressly stated otherwise, does not own the products listed by third-party vendors.

2. Acceptance of Terms

By accessing, browsing, registering on, or using NairobiDeals, you agree to be bound by these Terms & Conditions. If you are using the platform on behalf of a business, company, or other legal entity, you confirm that you have authority to bind that entity to these terms.

3. Marketplace Role

NairobiDeals provides the platform through which buyers and sellers connect. The contract of sale for products listed on the platform is generally between the buyer and the vendor.

• NairobiDeals provides: listing visibility, ordering flow, and marketplace support services.
• Vendors provide: product descriptions, pricing, inventory, delivery, and after-sale obligations unless otherwise specified.

4. User Accounts

5. Vendor Obligations

Vendors using NairobiDeals must act lawfully, fairly, and transparently. Vendors are responsible for the products they list and sell.

• Provide accurate, complete, and up-to-date product listings.
• Clearly state pricing, availability, delivery terms, and return conditions.
• Supply products that match their descriptions and images.
• Comply with applicable Kenyan laws, regulations, and consumer obligations.
• Avoid misleading, counterfeit, illegal, unsafe, or prohibited goods.

6. Buyer Responsibilities

Buyers are expected to review listings carefully before placing an order and to provide accurate delivery and contact information.

• Read product descriptions and vendor terms before purchasing.
• Provide accurate phone number, address, and delivery details.
• Complete payment when due and cooperate in order fulfillment where necessary.
• Raise product or delivery concerns within a reasonable timeframe.

7. Orders and Contracts

Orders placed through NairobiDeals are binding once accepted in accordance with the platform flow and payment confirmation process.

A contract of sale generally comes into existence between the buyer and the vendor when the order is accepted and payment is confirmed, unless a different process is clearly stated in the product listing or checkout flow.

8. Pricing and Payments

Product prices shown on NairobiDeals are typically set by vendors. Vendors are responsible for ensuring that their listings display correct prices and applicable charges.

• Payments may be processed through approved payment channels, including mobile money and other supported options.
• If a pricing error is discovered, the affected order may be corrected, declined, or cancelled before completion.
• NairobiDeals may assist in facilitating payment flow but is not a bank or licensed financial institution unless expressly stated.

9. Delivery

Vendors are responsible for dispatching and delivering products within the timelines stated in their listings or communicated during checkout.

• Delivery times are estimates unless expressly guaranteed.
• Delays may occur due to logistics, stock issues, weather, public events, or other factors outside reasonable control.
• NairobiDeals may assist with resolution but does not guarantee exact delivery times for third-party vendor products.

10. Returns and Refunds

Returns, replacements, and refunds are governed by NairobiDeals’ Refund & Returns Policy, as updated from time to time.

Vendors remain responsible for honoring valid returns and refunds on products they sell, subject to platform rules, listing terms, and applicable law.

11. Dispute Resolution

If a dispute arises in relation to an order, product quality, delivery, or payment, the buyer should first contact the vendor directly through the available support channels.

• Step 1: Buyer contacts vendor.
• Step 2: If unresolved, buyer may escalate the matter to NairobiDeals support.
• Step 3: NairobiDeals may review available evidence and facilitate a practical resolution.

NairobiDeals reserves the right to take reasonable action based on the facts available, including restricting accounts, requesting supporting evidence, or directing the parties to an appropriate remedy path.

12. Prohibited Activities

Users must not use NairobiDeals in any unlawful, abusive, misleading, or harmful manner.

• Listing counterfeit, stolen, illegal, or prohibited items.
• Uploading misleading descriptions, false claims, or deceptive images.
• Attempting payment fraud, charge abuse, or platform manipulation.
• Interfering with system security, data integrity, or platform operations.
• Using fake accounts, impersonation, or abusive conduct toward other users or staff.

13. Content and Intellectual Property

By uploading or posting content to NairobiDeals, including product images, descriptions, logos, reviews, or other materials, you confirm that you own or control the necessary rights to that content.

You grant NairobiDeals a non-exclusive, royalty-free right to use, display, reproduce, publish, and promote such content for the operation and marketing of the platform.

• Users must not upload content that infringes third-party rights.
• NairobiDeals may remove content that appears unlawful, infringing, unsafe, or misleading.
• All NairobiDeals platform branding, design elements, and proprietary materials remain the property of NairobiDeals or its licensors.

NairobiDeals may suspend, restrict, or terminate access to the platform at its discretion where there is:

• Violation of vendor listing rules or safety standards.
• Repeated unresolved complaints or regulatory concerns.

17. Changes to These Terms

Continued use of NairobiDeals after changes take effect constitutes acceptance of the updated terms.

18. Governing Law

These Terms & Conditions are governed by and shall be interpreted in accordance with the laws of Kenya.

Any dispute arising out of or in connection with these terms shall be subject to the jurisdiction of the courts of Kenya, unless otherwise required by applicable law.
